Evolution in Two Minutes

Terms and Conditions

1. Eligibility:  To submit a video for consideration in the "Evolution in Two Minutes or Less" Video Contest, (the "Contest") you must be 13 years of age or older.  Employees of Discover Media LLC ("Sponsor"), Brightcove, Inc. ("Brightcove"), or their respective affiliated companies or advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to participate.  By participating, contestants agree to be bound by these Terms and Conditions and the decisions of Sponsor and the Contest judges.  No purchase or payment is necessary to enter or to win.  The Contest is subject to all federal, state, local and municipal laws and regulations and is void where prohibited. 

2. How To Enter:  The entry period for Contest submissions will begin at 12:00 a.m. (E.T.) on April 1, 2009 and end at 12:00 p.m. (Noon, E.T.) on June 1, 2009 (the "Entry Period").  To submit a video for consideration in the Contest, visit http://discovermagazine.com/contests/evolution-in-2-minutes-or-less and follow all posted instructions.  You will be asked to enter your email address and a password to create a Brightcove account (or, if you already have a Brightcove account, to log in to that account) and will then be able to upload your video. Follow all posted instructions for uploading your video.  Only one entry per person (or per team, if an entry is submitted on behalf of a group) is permitted.  All video submissions must be no more than two (2) minutes in length and must be in one of the following video file formats: avi, QuickTime, 3gp, mpeg4, wmv, h.264, mpeg2, dv.  Videos may not contain materials that infringe any third-party's intellectual property rights.  Do not include copyrighted music or images in your video unless you have permission to do so.  Sponsor reserves the right to disqualify any entries that are alleged to infringe on any third-party's intellectual property rights or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.  Sponsor will not be responsible for late entries, for corrupted video files or files that are otherwise unplayable or inaudible, or for entries that do not meet the length or formatting requirements specified above, and all such entries will be disqualified.  Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Brightcove or Sponsor.  All entries become property of Sponsor and will not be returned.

3. Use of Personal Information:  By entering the Contest, you agree that the personal information submitted with your entry may be used by Sponsor in accordance with the terms of its privacy policy (available at http://discovermagazine.com/company/privacy-policy/) and also may be used by Brightcove in accordance with its privacy policy (available at http://corp.brightcove.com/privacy.cfm).  

4. Judging and Winner Selection:  Sponsor and Sponsor's selected adjudicator will judge all eligible entries and will select the five (5) videos that best explain Evolution in Two Minutes or Less.  Those five (5) videos (the "Finalists") will then be reviewed and one (1) winner (the "Winner") will be selected from among the Finalists.  Decisions of the Contest judges shall be final and binding in all respects.  The Winner and all Finalists will have their videos posted on the DISCOVERmagazine.com website.  Sponsor reserves the right to edit videos for length or content before displaying them on the DISCOVERmagazine.com website.

5. License and Release:  By submitting a video for consideration in the Contest (i) you grant Sponsor an exclusive, royalty-free and irrevocable right and license to edit, reproduce, publish, display, broadcast, stream or otherwise use your video entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, without limitation or further compensation; (ii) you represent that you have all rights necessary to submit the video and to grant Sponsor the rights granted in subsection (i), above; (iii) you represent that you have obtained the express consent of all other individuals (if any) appearing in the video (or, if such individuals are minors, that you have obtained the express consent of their parents or legal guardians) to submit the video in the Contest and grant Sponsor the rights granted herein; (iv) you agree that, if your video is selected by Sponsor as a Finalist or as the winning video, you will sign any additional license or release that Sponsor may require and, except for your own personal or classroom use, you will not post your submission on any other website, or otherwise publicly perform, distribute or display your submission, without the express permission of Sponsor; (v) you grant Sponsor permission to use your name, biographical information and likeness, in any media now known or hereafter developed, in connection with any use of your entry permitted herein; and (vi) you agree to release Sponsor, Brightcove and their respective affiliated companies, and the officers, directors, employees, agents and representatives of each, from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with Sponsor's exercise of the rights granted herein (including, without limitation, claims, costs, injuries, losses or damages related to copyright rights, rights of publicity or privacy, defamation or portrayal in a false light).
